Terms & Conditions

These Terms & Conditions are a legal agreement that sets out the rules for utilizing services provided by Tendernest Newborn Care & Nanny Services, & the Client. By using Tendernest Newborn Care & Nanny Services website you (the “User” & the "Client") agree to these terms & conditions. If you do not agree to the terms & conditions of this agreement, you should immediately cease all usage of this website. We reserve the right, at any time, to modify, alter, or update the terms & conditions of this agreement without prior notice. Modifications shall become effective immediately upon being posted on the https://www.tendernestnewborncare.com website. Your continued use of the Service after amendments are posted constitutes an acknowledgement & acceptance of the Agreement & its modifications. Except as provided in this paragraph, this Agreement may not be amended.

Retainer

To guarantee the services provided by Tendernest Newborn Care & Nanny Services, the Client agrees & may be required to provide a deposit, & sign a contract. Once the retainer fee is paid & Tendernest Newborn Care & Nanny Services receives the contract, services will be officially engaged, and the contract is committed. The Client agrees to remit the remaining balance for services provided on or before the last day of employment. Fee's for services provided & payment terms will be discussed between Tendernest Newborn Care & Nanny Services & the Client prior to signing the written agreement. 

Payment Agent

Tendernest Newborn Care & Nanny Services is authorized to deduct its fees & charges from payments due by Client to Tendernest Newborn Care & Nanny Services. Notwithstanding its obligations as payment agent, Tendernest Newborn Care & Nanny Services is not responsible for making payments to a caregiver until funds are received by Tendernest Newborn Care & Nanny Services from the Client.

 

Payment Terms & Fees; Payment Processing

Any deposits or fees that Tendernest Newborn Care & Nanny Services may charge the Client for services are due immediately in accordance with the terms discussed & agreed upon by Tendernest Newborn Care & Nanny Services & the Client & are non-refundable. This no refund policy shall apply at all times unless an arrangement is made in writting between Tendernest Newborn Care & Nanny Services & the Client. Tendernest Newborn Care & Nanny Services reserves the right to determine & change any payment term, rate, mechanism, third-party Service Provider, or structure at any time. We encourage the Client to check our website for the latest updates to payment terms. Tendernest Newborn Care & Nanny Services may use third party services to process payments. Tendernest Newborn Care & Nanny Services will use commercially reasonable efforts to ensure the security of all payment information such as credit cards or bank account numbers, Tendernest Newborn Care & Nanny Services expressly disclaims any liability for any damage that may result should any third parties gain access to such information, & the Client agrees to hold Tendernest Newborn Care & Nanny Services harmless for any damages that may result therefrom.

Confidentiality

While providing services to the Client, caregivers may legitimately see, hear, or otherwise become privy to information about the Client. The caregiver will always maintain confidentiality regarding the affairs of the household, its members, & respect the Clients right to privacy.

Cameras

Hidden cameras or other forms of surveillance equipment must be disclosed in full to any caregivers hired by the Client. If  surveillance of any kind or nature is used by or on behalf of the Client, & not disclosed to the caregiver, Tendernest Newborn Care & Nanny Services, & the caregiver may terminate services & retain all deposits & fee's.

References

Upon successful completion of services provided by Tendernest Newborn Care & Nanny Services & the Client, the Client agrees to provide a letter of recommendation to the caregiver. The Client will provide this letter on or prior to the last day of employment. Please understand that although writing a recommendation is a small inconvenience, it's enormously important to the caregiver's career. It's crucial that the Client print & sign a letter of recommendation on official letterhead if possible.
